For participation in the 2026 World Cup prediction game (hereinafter referred to as the “game”), organized by Messer SE & Co. KGaA for a limited time period from 11.06.2026 until 19.07.2026

Participation in the game is only permitted subject to compliance with the following Conditions of Participation. They are regarded as having been explicitly recognised following registration for the game.
1. Organizer
The organizer of the game is Messer SE & Co. KGaA, Messer-Platz 1, 65812 Bad Soden (www.messergroup.com).
2. General
2.1 The game is a game of limited duration run by the organizer, which will last from 11.06.2026 until 19.07.2026.
2.2 Participation in the game is only permitted subject to compliance with these Conditions of Participation. By registering, the participant explicitly recognises the Conditions of Participation.
2.3 Registration and participation are free of charge. They do not require the purchase of goods or the use of paid or free services offered by the organizer or third parties. They are not dependent on the participant paying connection and/or usage fees to the organizer or to other companies commissioned by the organizer with the technical implementation of the game. The participant also does not need to give his/her consent to receiving information about products or services provided by the organizer or third parties.
2.4 Any connection costs, which are incurred and are payable to the network provider as a result of participation in the game, as with any usage of the internet, be it via fixed network, mobile network or another way, are indicated. Such costs are to be borne by the participant. These costs may be considerable, particularly in the case of internet access using mobile devices with no flat rate tariff.
3. Game
3.1 The game is a prediction game, which primarily involves predicting the results of World Cup games. Predictions for individual matches can be made until the respective match has kicked off. You can see how predictions are evaluated and how many points are given for correct and partially correct predictions under “Game Rules - Points System”.
3.2 In addition, predictions can be made regarding the team line-up of the German team in individual games as well as which teams will be group winners and which will be runner-up and champion. Predictions for the line-up of the German team may only be made up to 24 hours before the start of the particular match, however, and predictions for which teams will be group winners, runner-up or champion may only be made up until the kick-off of the first game of the World Cup. 3.3 The winner is the participant with the most points after the final.
Insofar as prizes are awarded to winners and the participants with the next highest number of points, the following applies should several participants hold the same number of points: Each rank, i.e. first place, second place and so on, may only be occupied by a single participant. Should two or more participants have an equal number of points, the place that each participant holds shall be determined by drawing lots. A participant who loses the draw shall occupy the position below and push the other participants down one place. Should multiple participants with the same number of points be pushed down one place, lots shall be drawn to determine who shall occupy the position below.
3.4 Following each day on which a match is played, the participants shall be informed via email to the email address they provided of the score of the matches. Following the final match day, the winners will receive additional notification via email or post.
4. Preconditions for Participation
4.1 Only natural and legally competent persons aged 16 years or older may participate. Persons younger than eighteen years of age may participate if permission is provided by their legal guardian. In the case of doubt, the participant shall be obliged to prove his/her age and address.
4.2 Excluded from participation are persons who are not employees of Messer SE & Co. KGaA, or one of its subsidiaries.
4.3 Each participant may only participate on his/her own account, under his/her own name and with his/her own email address. It is not permitted to participate under numerous accounts by registering several times using different names or email addresses or for another person, such as as a “front man”.
5. Registration
5.1 It is possible to register and participate at any time.
5.2 Registration requires the participant to enter all the information marked as a mandatory field in the online registration form. This information must be complete and accurate. It will be necessary to enter a password and a nickname. The participants’ ranking in the high score list is published under their nicknames.
5.3 After registering, the participant’s game account will be activated using the nickname and password entered. The participant is to ensure that the password and account are not accessible by third parties and bears sole responsibility for all actions performed using such password or account. He/she commits to inform the organizer immediately via email of any misuse of the password or account.
5.4 There is no guarantee that registrations will be accepted. The organizer is entitled not to accept any registration without having to state any reasons.
6. Cancellation
A participant may terminate his/her participation at any time without notice. This is done by selecting the “Delete account” option under “Modify user data”. After confirming the “Delete account” request, all of the data concerning the participant, including his/her personal details, will be removed from the database of the organizer and the company commissioned with the technical implementation of the game, provided that there is no obligation to temporarily store data due to legal provisions.
7. Data Protection; Publication of Winners
7.1 The organizer and any companies it has commissioned with the technical implementation of the game are obliged to observe statutory regulations with regard to data protection. In this respect, we refer to the data protection declarations on the organizer’s homepage, the game homepage and/or the homepage of the company commissioned with the technical implementation of the game.
7.2 By registering, the participant declares his/her consent to the electronic saving and processing of the personal information provided when registering by the organizer or the company commissioned with the technical implementation of the game, to the extent that is necessary for carrying out this game. In the event of winning a prize, he/she also consents to the personal details necessary for the provision of the prize being passed on to the respective cooperation partners (e.g. a company that has donated a prize, a bank or a delivery company) and being stored by said partner until the provision of the prize is complete.
Should a participant be a prize winner, by registering, he/she declares his/her consent to his/her name (first name and surname) being published on the game homepage and the organizer’s internal communication channels. The participant is responsible for the accuracy of the name provided. The names are published without guarantee. The personal information will not be used for other purposes.
7.3 Insofar as there exists no statutory obligation for the temporary storage of data, all personal details collected in connection with the game will be deleted after the game has ended, the winners have been informed and the prizes have been awarded.
7.4 Each participant may revoke his/her consent to the storage, processing and transfer of his/her data at any time by terminating his/her participation in the game. The cancellation procedure is described above under Clause 6.
8. Exclusion from Participation
The organizer and any companies it has commissioned with the technical implementation of the game are entitled to exclude participants from further participation in the game at any time for good cause. Good cause shall exist in particular should a participant provide false personal details upon registration, should he/she participate in the game using multiple email addresses, should he/she attempt to manipulate, interfere with or influence the game or the proper course of the game or should he/she threaten or harm an employee of the organizer, a company commissioned by the organizer with developing or carrying out the game or another participant in the game. Should the preconditions for exclusion exist, prizes may also be refused and even reclaimed retroactively.
9. Premature Termination of the Game by the Organizer
The organizer reserves the right to end the game before the expiry of the planned game period without prior notification and without stating any reasons. The organizer shall take advantage of this option particularly in the event of the proper running of the game no longer being guaranteed for technical (e.g. viruses in the computer system, manipulations or hardware or software errors) or legal reasons.
10. Limitations of Liability
10.1 The organizer and the companies involved in developing and carrying out the game will do everything to ensure the reliable accessibility and functionality of the game homepage.
However, they cannot provide any guarantee that the game homepage will actually be accessible and functional without errors at all times.
10.2 The game will be run over a high availability computer network in a redundant, connected computer centre. Nevertheless, 100% availability cannot be guaranteed, as external interferences are unforeseeable and sources of error Europe-wide can result in a reduction in availability; the organizer has no influence over such circumstances.
The organizer, the company involved in providing the game and the computer centre will make every effort to resolve disruptions as quickly as possible.
10.3 No guarantee can also be provided that you will be able to participate in the game at all times in a disturbance-free and flawless manner on all mobile and stationary devices (PC, laptop, smartphone, tablet PC etc.). The majority of, but not all, devices run one of the operating systems required or the necessary screen resolution. There may be functional and/or display errors in the case of older devices in particular. In addition, the constant error-free transfer of data cannot be guaranteed over all mobile networks.
10.4 The liability of the organizer and of the companies involved in developing and carrying out the game is excluded in the case of any problems or shortcomings that are caused by the devices, networks and data transfer systems used by the participant in order to participate, including the receipt of data by the organizer or a company commissioned with the technical implementation of the game.
In particular, they are not liable for the loss, delay, amendment, manipulation and/or misdirection of emails and/or data during data input, data collection, data transfer and/or data storage, the cause of which lies in external data networks, particularly online, on external telephone networks or external mobile networks and/or external hardware or software, including the hardware and software used by the participant.
They are also not liable for the misuse of a participant’s password or account, for which the participant is culpable, or for incorrect information that is provided by the participant and/or third party or their hardware or software.
There is also no guarantee that emails or data entered into the input fields on the game homepage will correspond to system requirements or be accepted by the system.
10.5 Liability on the part of the organizer and the companies involved in developing and carrying out the game is also excluded in the event of the theft or destruction of the systems and/or storage media on which the programs necessary for the game and data collected in connection with carrying out the game are stored, in the case of force majeure resulting in technical disruptions, in the case of the amendment to or manipulation of the programs used for the game and/or data collected by participants or third parties in connection with carrying out the game, as well as for the conduct of other participants or third parties or for information or statements made or passed on by participants or third parties in relation to the game.
10.6 The exemptions from liability stated above under Clauses 10.1 to 10.5 for the organizer and the companies involved in developing and carrying out the game do not apply for damage or injury to life, body and health, nor do they apply for damage caused by the organizer and/or the companies involved in developing and carrying out the game, their employees, representatives and agents, through gross negligence or intent.
The liability of the organizer and the companies involved in developing and carrying out the game is unlimited in the event of culpable injury to life, body and health or in the case of gross negligence or malicious conduct.
In the event of slight negligence, they are only liable should one of the major contractual obligations regarding the fulfilment of the contractual purpose be violated; in this case, the claim for damages shall be limited to damage that is reasonably foreseeable.
10.7 The above exclusions and limitations of liability apply for all claims for damages, regardless of their legal basis and particularly in the case of pre-contractual and additional contractual claims. However, they do not restrict compulsory statutory liability or liability for a guarantee, insofar as they should have protected the participants from the damage that occurred.
11. Prizes; Expiry of Claims to Prizes
11.1 The winner of the betting game can donate EUR 500 to a social project of their choice. In the event of a tie, the winner will be drawn by lot.
11.2 The entitlement to prizes expires three month following the prize notification message being sent, should the winner not be reachable or should he/she not contact the organizer by the deadline.
12. Place of Fulfilment and Jurisdiction
It is agreed that, insofar as is legally permissible, the place of fulfilment and jurisdiction shall be Bad Soden (Ts.). Insofar as the participant has no general jurisdiction in Germany or moves abroad following participation, Bad Soden (Ts.) shall be accepted as the place of jurisdiction.
13. Applicable Law
In the event of disputes, the exclusive applicable law shall be German law, to the exclusion of conflict of law provisions as well as the UN Convention on Contracts for the International Sale of Goods.
14. Exclusion of Right of Appeal
There shall be no right of appeal.
15. Other
15.1 Deviations from these Conditions of Participation must be made in writing in order to be valid. This is also required for the revocation of this requirement for the written form.
15.2 Should individual provisions of these Conditions of Participation be or become invalid, this shall not affect the validity of the remaining provisions.
